John's hourly rate for arbitrations is $500 per hour. The hourly rate includes study time. Preliminary matters, hearings, deliberations and writing the award. The parties and John will mutually agree on how much time to reserve for the arbitration hearing during the preliminary scheduling conference. The parties must pay the estimated fees in advance of the arbitration by a date that will be established during the preliminary scheduling conference
John charges $500 per hour, with a four-hour minimum for mediations. This fee is divisible by the number of "sides" present in the dispute, unless the parties agree otherwise. The parties must deposit these fees in advance of the mediation by the date that will be set forth in John's retainer agreement. As to John's four-hour minimum, he allocates one hour to pre-mediation preparation time and three hours for the actual mediation. Any additional time is billable at $500 per hour.
John recommends that counsel prepare a brief to be exchanged with opposing counsel, while also providing a supplemental "confidential" brief to John. The first brief, to be exchanged with opposing counsel, should be prepared on line-numbered pleading paper, and the supplemental "confidential" brief should be prepared on counsel's letterhead. John recommends that clients be provided with the opposing counsel's brief, as well as their own, before the mediation so that clients can be prepared as much as possible to discuss the concerns that are likely to arise at the mediation. Briefs are requested five business days before the date scheduled for the mediation.
John recommends that counsel discuss their plans regarding who will attend the mediation prior to the mediation. The structure of the mediation, including the sequence and timing of joint sessions, private caucuses, and attorney-only caucuses, can be adjusted to meet the needs of the participants. John is available for pre-mediation phone consultations and conference calls to address any concerns that may arise in this process.
